CMPO to appeal Civil Court's verdict and submit request to Appeal Court to delay enforcement of the verdict


CMPO has prepared to appeal Civil Court's verdict and submit request to the Appeal Court to delay enforcement of the verdict. It would also ensure fair investigation in all cases.

February 22, 2014, at 1300hrs at Center for Maintaining Peace and Order (CMPO), Narcotics Suppression Bureau, Vibhavadi Rangsit Road, Bangkok, Department of Special Investigation (DSI) chief and CMPO committee Tarit Pengdit, Deputy Spokespersons of Royal Thai Police Headquarters Police Colonel Krishna Pattanacharoen and CMPO Official, Miss Sirima Sunavin announced following outcomes of the CMPO meeting.

1) On the Civil Court’s verdict and enforcement of the case filed by Mr. Thavorn Senniam against defendant no. 1, Ms. Yingluck Shinawatra et al which has resulted in CMPO not being able to implement its tasks in accordance with the legal principles, CMPO Director has today submitted a letter to the prosecutors to appeal against the Civil Court’s verdict and would submit request to the Appeal Court to delay enforcement of the verdict on February 24, 2014. The CMPO Director was certain that CMPO would win the case since the Emergency Decree was announced in the same manner as the one in 2010 against which Mr. Prompong Nopparit filed a case, and was dismissed by the Civil Court.

2) On Civil Court’s reference to the Constitutional Court’s ruling that PDRC protest has been conducted with peacefulness, openness and no arms, thereby, a legitimate protest, CMPO has resolved that the aforementioned ruling of the Constitutional Court was based on the initial stage of the PDRC protest which was conducted against the Amnesty Bill. However, the PDRC did not stop even after the Amnesty Bill was withdrawn, but instead, upgraded its protest to the anti-Government movement with various law-violated activities including attempts to block the general election both in Bangkok and in the Southern provinces. In light of this, on February 25 (Tuesday), CMPO would file a petition to the Constitutional Court for its consideration on the unconstitutional movement of PDRC now.

3) From the previous clash between PDRC protesters and police on February 18, 2014 at the area around Phan Fa Lilat Bridge, which resulted in 5 deaths and 68 injured among both side, CMPO ordered the police to expedite the investigation process and would update the public of the progress.

CMPO would like to emphasize and reaffirm that investigation of the Phan Fa Bridge incident would be straightforwardly conducted by means of forensic sciences. In order for the thorough investigation, it would take a little more time for the results to be publicly announced. At this stage, CMPO would, therefore, like the public to wait for official results of the investigation since it would be legally complete and accurate. CMPO also investigated into the VDO clips and photos that PDRC leaders presented earlier and found that those materials were factually distorted.
